TERMS AND CONDITIONS The Active Team mobile application (Service) and its contents are owned or licensed by the University of South Australia (we, us or our). USE OF ACTIVE TEAM APP You may only use the Service if you are at least 18 years of age. Our questionnaires are not intended for persons under 18 years of age and we do not knowingly collect personal data from, or allow, such persons to register as users of the Service. If it comes to our attention that we have collected personal data from such a person, we may delete this information without further notice. AGREEMENT TO TERMS AND CONDITIONS To the maximum extent permitted by law, these terms and conditions (Terms and Conditions) govern the use of the Service, and we may amend them from time to time. Every time you use the Service , you are acknowledging to us that: (a) you have read the Terms and Conditions as they stand at the time and agree to be bound by them; and (b) are at least 18 years of age. If you do not agree to these Terms and Conditions, you must immediately uninstall the Service and discontinue its use. If any of these Terms and Conditions are illegal or unenforceable at law, they may be severed and the remaining Terms and Conditions will continue in full force and effect. OUR INTELLECTUAL PROPERTY Unless expressly stated otherwise, we own or have rights to use all content appearing on the Service (including trade marks, logos and copyright material). You must not use any trade marks, logos, copyright material or other content on the Service, except with our express written consent or as permitted under applicable Australian and international laws. CONTENT WE PROVIDE Unless stated otherwise, we grant to you a personal, non-transferable, non-exclusive and revocable license to use the Service on your personal device or devices and only on an Apple or Android device in accordance with this Agreement We cannot guarantee that any information obtained from the Service is free from computer viruses, other faults or defects. It is your responsibility to scan the information for computer viruses, and you assume the risk of any damage to your computer and associated equipment arising out of installation, downloading or use, of content or materials on the Service. LINKS TO EXTERNAL WEBSITES The Service may contain links to other websites or advertisements of goods and services available from third parties. We are not responsible for the content of those websites or advertisements, or any goods or services made available on them. Unless we expressly state otherwise, we are in no way endorsing, sponsoring or suggesting an affiliation with that party or their goods or services. CONTENT YOU PROVIDE The Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos or other material. You are fully responsible for any content that you submit to us via the Service. By providing content to us (including any responses to our questionnaires), you grant us a licence to use that content for our research purposes without a licence fee or further reference to, or acknowledgement of, you. You agree that you will not use the Service to post or display: (a) content that you do not have the right to post or display, or that violates the intellectual property, confidentiality, privacy or other rights of any person or entity; (b) content that is offensive, abusive, defamatory, discriminatory or false or misleading; (c) advertising or promotional materials of any kind; or (d) content that contains software viruses or anything harmful to the Service. We reserve the right to edit or remove any user content at any time. YOUR PERSONAL INFORMATION AND PRIVACY We will handle all personal information collected from you in accordance with our Privacy Policy, a copy of which can be viewed here. Our Privacy Policy sets out the physical, electronic and security measures we will take to protect your personal information. We may use the information that we collect from you for research, education and health promotion purposes, and to provide, maintain and improve the Service. You agree that we may contact you to obtain your feedback on the Service, provide you with updates and to inform you of other goods and services offered by the University that may be of interest to you. In respect of your use of the Service, please note that: (a) whilst personal information gained from your use of the Service may be published and used for research and academic purposes, you will not be identified in the publication; and (b) subject to ethics approval, your anonymised raw data may be viewed by other third parties assisting us with our research. When you register as a user of the Service, you will receive a login and password in order to access the Service. You are responsible for maintaining the confidentiality of your login and password and will remain responsible for any activities that occur using your login or password. You will notify us if you become aware of any unauthorised use of your password. By supplying us with personal information through this the Service, you accept the inherent security risk of dealing online over the internet. To the maximum extent permitted by law, you agree not to hold us responsible for any unauthorised access to your personal information. Downloading the Service on your device will give us access to some aspects of your Facebook account, including your name, email address, profile picture, and friends list. You give us permission to access, collect and use this information in accordance with these Terms and Conditions. We will only be able to view friends within your friends list if they have also downloaded the Service. You have the option to set your Active Team profile to public or private. These settings can be changed at any time using the toggle in the Privacy section of the settings menu. If you choose a public profile, all users of Active Team will be able to view certain information about you including your step counts on your best day, last week, and total step counts, and how you rank in terms of step counts in comparison with other users. In addition, if you have a public profile, all users of the Service will be able to see your posts on the news feed feature. If your profile is set to private, only users of the Service who are your Facebook friends will be able to see your aggregated step data, newsfeed posts, or your profile. NOT PROFESSIONAL OR MEDICAL ADVICE In some instances, you may be asked questions pertaining to your health. The Service (and the materials which are accessible from it) are not a substitute for independent professional advice from an appropriately qualified medical practitioner or specialist. No information provided on the Service, or questions asked of users, are intended to be used as medical advice, nor should it be used for therapeutic purposes. COMPLAINTS HANDLING We take your complaints about privacy matters seriously and our complaints handling procedure is set out in our broader Privacy Policy available here. LIMITATION OF LIABILITY We provide the Service on an “as is” basis. We will take all reasonable steps to ensure that the materials and other information this the Service is accurate, but make no representation as to its accuracy, completeness, currency or the reliability of its content. To the maximum extent permitted by law, all warranties and implied terms are excluded from these Terms and Conditions. If we are found to be providing any services to you for which any warranty or term is implied by law in these Terms and Conditions, our liability is limited to, at our discretion: (a) supply of the services again; or (b) payment of the cost of having the services supplied again. To the maximum extent permitted by law, you also waive any and all claims that you may have against us arising from your use of the Service. GOVERNING LAW To the extent permitted by law, the laws of South Australia, Australia, govern these Terms and Conditions.
